The U.S. International Trade Commission is increasingly the premier forum for intellectual
property litigation in the United States. The Commission is, of course, also an essential
part of the administration of the U.S. trade remedy laws, and maintenance of the
Harmonized Tariff Schedule of the United States, as well as a primary advisor to the
President, USTR, and Congress on matters relating to tariffs and international trade and
competitiveness. Join us for this unique opportunity to hear from the Commissioners and
knowledgeable practitioners about recent developments at the Commission.

First Roundtable: Jurisdiction Under Section 337
This panel will examine recent developments in the ITC's jurisdiction under Section 337,
including: the domestic industry requirement and non-practicing entities, the
importation requirement and indirect infringement (as most recently discussed in
Electronic Devices with Image Processing Systems, Inv. No. 337-TA-724), and
jurisdiction over the use of trade secrets outside of the United States (as most recently
discussed in the Federal Circuit decision in Tianrui Group Co. v. Int’l Trade Comm.).

Second Roundtable: An Intimate Q&A Session with the ITC Commissioners
Moderated by Jeffrey M. Telep, King & Spalding
Join us for a roundtable discussion with the ITC Commissioners. Possible topics include:

Recent substantive and procedural developments at the Commission, including developments in Section 337 and Title VII law and procedures;

Recent Section 337 developments and their impact, including the increase in the number of cases, the technological complexity of many of the cases, and the establishment of the ITC mediation program;

Other new developments at the Commission that might affect its proceedings, including personnel developments, changes in the EDIS system and other Commission facilities, and the impact of a growing case load;

The history and policy of Section 337, including some of its unusual provisions, such as the domestic industry and importation requirements;

The evolution of Title VII practice at the Commission;

Recent Commission reports on subjects such as China’s indigenous innovation policies;

Best practices tips for appearing before the Commission; and
-
Other developments that may affect U.S. trade law in the coming year.
In addition, the Commissioners are generally open to responding to questions from the
bar as long as they do not touch on current issues for decision before the Commission.
